TERMS AND CONDITIONS

Please read the following Terms and Conditions carefully before purchasing a Pacific Sport Celebrations Netball package. By placing an entry Pacific Sport Celebrations Ltd you agree to be bound by each of the provisions of these Terms and Conditions.

References to "Pacific Sport Celebrations", "us", "we", and "our" are to Pacific Sport Celebrations Limited, and references to "you" are to you as the customer that purchases (or otherwise obtains) an entry package from Pacific Sport Celebrations Ltd.

 

KEY PAYMENT TERMS:
Your Team Registration of NZ$500 per team or NZ$100 per individual is non-refundable.

NOTE: If you cancel your booking, the cancellation fees below will apply.

 

ENTRY PACKAGE:

  • Deposit of NZ$100 per person is required to secure your entry.

  • First instalment NZ$100 per person is required on or before 30 September 2024

  • Final payment of NZ$195 per person is required on or before 31 December 2024.

  • Pacific Sport Celebrations Ltd are not liable for remitting bank fees and requires you to cover those costs.

  • Credit card fees will apply to all payments made by credit card.

  • Late payments will be subject to a 5% Late Payment Fee at the discretion of the organisers.

ACCESS TO EXCLUSIVE ACCOMMODATION PRICING:

Upon submitting your entry, you will receive a Booking Code that allows you to access the special accommodation prices listed and offers free WiFi for participants.

BOOKING CONDITIONS:
If you are making a booking for more than one person or for a team, you will become the Team Manager.  You may also enter as an individual player.  As Team Manager or Individual Player, you are responsible for:

  • Making full payment for the entry package including any cancellation or amendment charges.

  • Keeping all other people for whom the booking is made fully informed as all documents and information regarding the entry will be sent to the Team Manager.

  • All persons participating as players or supporters must accept and sign the waiver, release and indemnification requirements before attending the event.

  • Entries may be from teams or individuals.

  • All participants must purchase one of the packages provided by the organisers.

  • All prices are in New Zealand Dollars and are on a per person basis.

  • Entries close 31 December 2024 (unless sold out prior) or at any other time at the discretion of Pacific Sport Celebrations Ltd

 

INSURANCE:
You must purchase adequate insurance including sports injury cover.

 

CONSENT TO PHOTOS: 
Photographers and film makers may attend the event and may capture your image. It is a condition of purchase of a festival package that you consent to use of your image and likeness by Pacific Sport Celebrations Ltd for whatever purpose we see fit, including marketing our services in brochures and/or any website.  If you do not wish to provide your consent, you must advise us prior to the travel date.
 

LEGAL CONTRACT:
When you make a booking with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms and policies and by the conditions of the supplier. You must not make any booking through this site unless you understand and agree all our terms and policies. Once payment is made for the booking, it is deemed that you have read and understood the terms and conditions for the booking. If you have any queries, please contact us before making any booking for any service.

 

PRICES:
Prices are based on payment by internet banking.  Entries using credit card will incur a 4% credit card service charge which is not included in the package price. 

Please note that for contractual reasons, the package price cannot be itemised.  The package price only includes the services specified in your entry.  Any personal incidental costs incurred during travel are excluded.

Prices are based on supplier costs, exchange rates, taxes, levies, and surcharges at the time of preparation.  Prices are subject to change due to currency fluctuations, inflation and/or increases in supplier costs and regulatory charges at any time until full payment is received.  If we advise you that the price of the tour has changed substantially pursuant to this, you have the right to cancel your booking and we will refund your deposit to you.
 

DEPOSIT & PAYMENT
Our contract with you begins upon receipt of Team Registration/deposit and/or full payment.  After placing a booking, you will receive:

  • An entry confirmation that details the inclusions of the entry package(s) purchased; and

  • The applicable invoice and/or receipt.

These should be checked very carefully, and if any details are incorrect, you must inform us within five working days.  

Please see the payment schedule for payment deadlines.

Payments can be made by online bank transfer, Visa, Mastercard, or American Express.  Please note that a credit card service charge of 2.0% will be incurred for any payments made by Visa or Mastercard and 3.1% for any payments made by American Express.

If you pay by internet banking, please quote your booking reference and surname or invoice number to enable us to allocate your payment correctly.

 

CANCELLATION
All cancellations must be advised in writing by post or email to Pacific Sport Celebrations Ltd from the person that made the booking and are only effective from the date they are received by our office.


Application of refunds:

Team and individual entry registration fees are non-refundable.

Prior to 31 December 2024  - Full refund of payments excluding Team Registration Fee.

Prior to 15th February 2025 - 50% of fees paid excluding Team Registration Fees             

Most of our arrangements with suppliers are non-refundable and we are under no obligation to pursue any of our suppliers for refunds.

Setting up an event is complicated, as is cancelling arrangements.  We recommend you obtain travel insurance to cover any cancellations prior to and during your travel.

UNUSED SERVICES
Once your package services have commenced, refunds will not be provided where due to illness or personal choice you do not utilise part of or all the package inclusions. 

ACCOMMODATION 
The booking of accommodation is at the discretion of the team or individual. Teams will be required to advise Pacific Sport Celebrations Ltd of the full booking arrangements made.

OUR RESPONSIBILITIES
The services that we supply consist solely of: 

  • Arranging and coordinating game days and events.

  • Providing details of recommended accommodation, transfers, attractions and suppliers.

  • Offering Celebration merchandise.

  • Assisting with bookings for customers for the provision of services and facilities by suppliers.

We undertake to perform these services in accordance with the law, with reasonable care and skill.  However, we will not be held liable for any loss, damage, or claim arising from acts or defaults outside the control of Pacific Sport Celebrations Ltd and its employees - including (but not limited to) suppliers of travel, accommodation, game days and events in connection with your package. 

To the extent permitted by law, our liability to you and your party will be limited to the value of the total cost of your package.

 

PASSPORT AND VISA REQUIREMENTS 
You must check passport, visa, immigration, health, and customs regulations and requirements well in advance.  It is your responsibility to ensure you have the correct documentation to allow your entry overseas and/or return to your home country. 


FORCE MAJEURE
If we are delayed in or prevented from performing our obligations due to an event of force majeure (including, but not limited to, natural disasters, war or riots, pandemics, closed or congested airports, or technical problems), then such delay or non-performance shall not be deemed a breach or entitle a claim for injury, damage, loss, delay, additional expenses or inconvenience. Our obligations shall be suspended while such an event of force majeure continues. 

 

LIMITATION OF LIABILITY
Except as required by law (and to the minimum extent required by law), neither party shall be liable to the other for any indirect or consequential losses, costs or damages that arise out of or that are in connection with any duty or obligation under these terms and conditions or any duty or obligation at law.

To the extent that we have any liability to you under these terms and conditions or at law, that liability shall be capped to the amount that you have paid or is payable to us in accordance with these terms and conditions.

 

ACCURACY
All reasonable care has been taken to ensure the accuracy of information on the website and other published material - however, prices and services offered are subject to change.

GOVERNING LAW
These terms and conditions are governed by New Zealand law and the courts of New Zealand shall have exclusive jurisdiction to settle any dispute which may arise from these terms and conditions.
